Commercial and industrial premises: deposits follow the written tenancy; financing depends on the borrower, property and bank product. Housing-loan assumptions do not automatically apply.

Budget for the agreed deposits and advance rental, legal work, stamp duty, applicable tax, utility opening or upgrades, licences, fit-out, moving and working capital. Then list recurring rent, service charges, utilities, insurance and maintenance separately. A low monthly asking rent is not the full cost of occupation, and refundable deposits still tie up cash.
Do not count advance rental twice or treat a refundable deposit as an operating expense that disappears permanently. No universal number of months covers every business's start-up cash.
There is no single deposit package that applies by law to every shop lot or factory. Security, utilities, advance rental and any renovation or management deposits must be separately agreed in writing. The amount can reflect the tenancy, business activity and agreed risk. Advance rent pays for the specified rental period; it is not another refundable security deposit.
A residential '2+1+0.5' arrangement is not a statutory rule for commercial premises. Never assume a deposit can replace the final rental payments without written agreement.
For an ordinary property tenancy or lease without a fine or premium under Item 49(a), each RM250 or part of average annual rent and other annual consideration attracts RM1 for a term up to 1 year, RM3 for over 1 to 3 years, RM5 for over 3 to 5 years, or RM7 for over 5 years or an indefinite term. Do not deduct the former RM2,400 band. Classification and other charges still need confirmation.
The old RM1/RM2/RM4 table is outdated. Premiums, multiple instruments and special consideration can change the duty; a simple estimate is not the final tax assessment or total legal fee.
The applicable rental/leasing service tax rate is 6% from 1 January 2026, but charging depends on the provider's registration, service scope and valid exemptions. A genuinely refundable security deposit is not subject to this service tax; a sum forming part of payment for rental services is treated differently. Eligible SME tenants can check MyPMK relief, which is conditional rather than automatic.
A small individual unit's rent or an SME label alone does not prove exemption. Do not apply the old 8% rental rate or assume an expired transitional relief still applies.
They serve different purposes. A landlord's utility deposit secures specified bills; a provider such as TNB may require its own account deposit. A fit-out deposit secures agreed renovation obligations. A rent-free fit-out period only exists if agreed, with clear access and rent commencement dates. It does not automatically waive utilities, service charges or other costs.
Do not assume a second utility deposit is automatically unnecessary or that a fit-out period will be extended if approvals are delayed; agree the specific treatment in writing.
These are general explanations. An individual property, application or agreement still needs confirmation.
